FLORIDA MARRIAGE LICENSE INFORMATION

Q: What is needed to get a marriage license?
A : Driver's license or other acceptable identification and be prepared to pay the $93.50 fee in cash.

Also required is for both applicants to provide a Social Security card or another form of identification to include the Social Security number. Applicants who are not citizens may provide a Social Security card, immigration registration card or passport.

Applicants are required to read the family law handbooks and once completed sign an affidavit to that effect. FS 741.04(B)

Q: Do I have to pay the fee in cash?
A : Yes.

Q: Do both parties have to be present at the clerk's office to apply for a license?
A : Yes. 

Q: Are we required to have a blood test to apply for a license?
A : No. 

Q: How long does it take to get a license?
A : There is a  three-day waiting period between application and the effective date of a marriage license. The waiting period can be waived if applicants show proof of having recently attended at least four hours of marriage counseling with a provider registered with the Clerk's Office.

Q: What are the age restrictions for obtaining a marriage license?
A : To obtain a license without parental consent, both the male and female must be at least 18 years of age. The 18 year minimum age does not apply for individuals who have been married previously. The age requirement can be waived by a county judge for applicants who can prove they are parents or expectant parents.

Q: Can an individual who is younger than 16 get a marriage license from the Clerk's Office with parental permission?
A : No. With or without parental permission, a marriage license to anyone under age 16 can only be issued by a county judge.

Q: Is the signature of just one parent sufficient to qualify as parental permission for a minor to marry?
A : No. Permission of one parent is only sufficient if that parent has sole legal custody of the minor or if the other parent is deceased.

Q: How long is the marriage license valid?
A : 60 days from the effective date of the license. The marriage license form must be returned to the Clerk's Office for recording within 10 days after the marriage is performed.

Q: How long does it usually take to get a certified copy of our marriage record?
A : Certified copies are normally received within 10 days after the completed marriage certificate is returned to the clerk's office for recording in the county's official records.

Q: How much does it cost for a certified copy of a marriage certificate?
A : One certified copy is provided as part of the marriage license fee. There is no additional cost. Extra certified copies may be obtained for a fee of $2 each.

Q: Do one or both of the marriage license applicants have to be American citizens?
A : No. There is no citizenship requirement.

Q: Can the Clerk's Office perform the marriage for us?
A : Yes. Deputy clerks can perform a civil marriage ceremony. There is a $20 (cash only) fee for performing the service.

Q: Do we have to make an advance appointment for a license and civil marriage ceremony?
A : No. Licenses are issued and marriages performed without appointments during normal business hours ( 8:30 a.m. to 4:30 p.m. , Monday through Friday). We request that you come in between 9 a.m. and 4 p.m. if you want a license to be issued and ceremony to be performed at the same time.


Q: How do we go about renewing our marriage vows?
A : Talk to your clergyman, chaplain, other religious adviser or personal counselor.

Q: Do I need my divorce papers (or spouse's death certificate) in order to apply for a marriage license?
A : No. You do not need the documents, unless your marriage ended in the last 30 days. However, the application does require you to note how your last marriage ended (divorce, annulment or death) and the exact date (month, day, and year)..
